The Information Officer is responsible for ensuring Capital Foundry’s compliance with PAIA and POPIA. This includes facilitating access to records, responding to requests, and maintaining the PAIA Manual.


3. The PAIA Section 10 Guide

In terms of Section 10 of PAIA, the Human Rights Commission has compiled a guide containing information to assist individuals wishing to exercise their rights under the Act. Each request for access will be considered on its own merit and in accordance with applicable legal restrictions.


6. Request Procedure

Requests for access to records must be made using the prescribed Form C, available from the Department of Justice and Constitutional Development’s website. The form must be completed in full and submitted to the Information Officer via email or hand delivery.

Step-by-Step Process:

  1. Complete Form C, ensuring all fields are filled.
  2. Email the form to info@capitalfoundry.co.za or deliver it to our offices.
  3. Pay the applicable request fee, if required.
  4. Await written acknowledgment and decision within 30 calendar days.

If access is granted, a further access fee may be charged depending on the number of pages or method of delivery. If the request is refused, reasons for refusal will be provided and the requester may seek recourse through mediation or the courts.

7. Grounds for Refusal

Capital Foundry reserves the right to refuse access to records under certain conditions defined in PAIA. These include but are not limited to:

  • Privacy of a Third Party: Records that contain personal information of third parties without their consent.
  • Confidential Commercial Information: Includes trade secrets or sensitive business information.
  • Legal Privilege: Communications protected under attorney-client privilege.
  • Security of the Company or Individuals: Includes physical or digital security documentation.
  • Ongoing Investigations: Access that may compromise investigations or legal processes.

The company aims to apply refusal clauses fairly and only where justified by law.
